How does the law differ for weddings in Scotland, compared to England?

The legal requirements for getting married in Scotland are slightly different to those in England. For example, in Scotland, you can get married outdoors or in a place that's not registered for marriages, as long as you have a Humanist celebrant to conduct the ceremony. Additionally, Scottish marriage certificates include the names of both parents, whereas English certificates only include the father's name. However, the process of giving notice of marriage is similar in both countries.

What do you have to do before you get married in Scotland?

Before getting married in Scotland, there are a few legal requirements that must be met. Both parties must be at least 16 years old, not closely related, and not already married or in a civil partnership. Each person must provide proof of identity and residency, and give notice of their intent to marry at a designated Registrar's office. The notice must be given at least 29 days before the wedding, but no more than three months in advance. A fee is required to give notice and obtain a marriage schedule, which must be presented to the person conducting the ceremony on the wedding day.

Do you have to give notice to marry in person, in Scotland?

Can you give notice at a registrar's office in England?

Can you give notice online, to get married in Scotland?

How many witnesses do you need to get married in Scotland?

In Scotland, you need two witnesses to be present at your wedding ceremony. These witnesses can be anyone over the age of 16, and they must be able to understand the language used in the ceremony. The witnesses are required to sign the marriage schedule along with the couple and the person conducting the ceremony. Members from our Melville team can be witnesses, if you are planning a runaway ceremony just for two!

Can you help us plan a destination wedding in Scotland?

100%, yes we can! We can help you design the fairytale wedding of your dreams, all from afar, and we would be delighted to help.
